1. Acceptance of Terms

By accessing or using Lumynex (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you may not use the Service. We may update these terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Your Account

You must create an account to use the Studio. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate information and be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.

3. Subscriptions & Payment

Access to the Studio requires an active paid subscription. Subscriptions renew automatically at the end of each billing period until cancelled. Fees are non-refundable except where required by law. We reserve the right to change pricing with reasonable advance notice; changes apply from your next billing cycle.

Each plan includes monthly usage allowances (such as avatar videos and saved avatars). Unused allowances do not roll over to the next month.

4. Your Content & AI-Generated Output

You retain ownership of the images, audio, scripts and other materials you upload ("Your Content"), and of the videos and media generated from them ("Output"). By uploading content, you grant us a limited licence to process, store and transmit it solely to provide the Service.

You represent that you have all necessary rights to Your Content. You must not upload the likeness or voice of any person without their consent, and you must not use the Service to impersonate any person, create misleading or deceptive media, or generate content that is unlawful, defamatory, harassing, or infringes any third party's rights.

5. Acceptable Use

You agree not to misuse the Service, including but not limited to: attempting to access other users' data, reverse-engineering the platform, circumventing usage limits, reselling access without authorisation, or using the Service to produce disinformation, adult content involving real persons without consent, or content that violates any applicable law.

We may suspend or terminate accounts that violate these terms, with or without notice, and without refund.

6. AI Disclaimer

The Service uses third-party artificial intelligence models. AI-generated output may contain inaccuracies or artefacts and is provided "as is". You are solely responsible for reviewing Output before using or publishing it, and for how you use it. We recommend disclosing that content is AI-generated where appropriate or required by law.

7. Limitation of Liability

To the maximum extent permitted by law, Lumynex and its affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

8. Termination

You may cancel your subscription at any time; access continues until the end of the paid period. We may suspend or terminate the Service or your access to it for breach of these terms. Upon termination, your right to use the Service ceases, though provisions that by their nature should survive (such as ownership and liability limits) will remain in effect.

9. Governing Law & Contact
